FOGGED WINDOWS, PART II

Introduction:
Last week's question was an introduction to fogged windows; so based upon the explanation of how a window fails and becomes fogged. I'll ask a question for which every Agent should know the answer...

Question:
True or False? "Fogged" windows are defined as a "warranted" item in the FAR contract.
Answer:
FALSE - FALSE, FALSE, FALSE! If you are one of the few Agents who answered TRUE to last weeks question, please read Paragraph 8 in the FAR contract. Personally, I believe that fogged windows are damaged components, and should be defined as warranted (because they do not function as originally intended or designed). BUT my opinion is not included in the FAR contract, which defines the condition as "COSMETIC". As a professional home inspector, I am honored to assist with ECAR's Jump Start program, and one of the key points I make while talking about the inspection process is this: if you see a fogged window, and you want it replaced - include that in the offer you present.
