INSPECTION DAMAGE

Introduction:
Electrical concerns are important for Buyers and Agents to understand, but a competent inspector should be able to assist you with the explanation of the difference between AFIs and GFIs. Let's jump into a real world scenario that happened recently...

Question:
True or False? The Seller is responsible for any damage to the property incurred during the Inspection process.
Answer:
FALSE - Under the FAR-9, line 149 states the the "Buyer will repair all damages to the Property resulting from the inspections..." , BUT Paragraph 8, does require the Seller to "keep the Property in the same condition from Effective Date until the closing..."

So, anything that is damaged during the inspection is the Buyer's responsibility, but anything that breaks or is damaged after the inspection but prior to close of sale is the Seller's responsibility.

The FAR-9 gives the Buyer the opportunity to perform a walk through inspection or reinspection, and I encourage Buyers to use the walk-through to ensure the Seller has met the Maintenance Requirement.
