Introduction:
Based upon the answer to last week's question about the cause of stinky water, how does this condition effect the inspection findings and home purchase?

Question:
True or False? The strong sulfur smell often associated with hot water is a 'warranted condition' which should be corrected per the standard warranty and repair section in the contract.
Answer:
FALSE - As best I can tell, this condition is outside the scope of conditions described in Paragraph 8 of the FAR. However, I am not giving legal advise, and strongly recommend you contact a real estate attorney or FREC if this condition becomes a contractual issue. As the condition is not a result of a failed mechanical system (which is the responsibility of the home inspection survey) and there is not a significant health risk, it is not a 'warranted item'. However, as the odor creates such an unpleasant environmental condition, it is one that should be corrected - even if the property is not being sold.
